Note: Buried in Lexington Co, SC. Buried with his wife in unmarked graves, Seeds of Jacob Jeffcoat, Pg 23. This Benjamin, named for his uncle is referred to in census and on legal papers as Benjamin Jeffcoat, Jr. Owned several thousand acres of land in Lexington Co. Mary: Seeds of Jacob Jeffcoat pg 23.(1541) shows as a Jr.(1596)shows Benjamin owned several thousand acres of fine timber land in Lexington Co. Some was cleared for farming. His land was devided between his ten children after his death. There was a will from Benjamin to Barbara dna her son Samson King. The original plot to this land is owned by Harvey Justus, a family decendent.

To the honorable Chancellor of the state aforesaid,
Honorably complaining herewith unto your Honor, your Orator and Oratrix, John Irvin Chaney, Zilphia Chaney, Lewis Barrs, Martha A. Barrs, Elijah H. Barrs, Benjamin L. Barrs, Jacob Jeffcoat, Mary Jeffcoat, Michael Sharpe and Martha A. Sharpe that Claiborne Johnson Jeffcoat departed this life on the _____-day of October AD, One thousand and eight hundred and fifty one, intestate and without issue, leaving as his heirs at law and distributes his mother, Mary Jeffcoat and the following brothers and sisters to wit, Zilphia China, Eliza E. Barrs, Mary Jeffcoat, Martha A. Sharpe, Benjamin Jeffcaot, Uriah Jeffcoat, Wesley Jeffcoat, Nancy Caroline Williamson, Elijah H. Jeffcoat and Daniel J. Jeffcoat. That John Irvin Chaney is the husband of Zilphia China and Thomas Williamson intermarried with the said Nancy Caroline.
The Eliza E. Barrs departed this life on the twenty fourth day of February, One thousand and eight hundred and fifty three, leaving her husband, Lewis Barrs and the following children to wit, Martha A. BArrs, Elijah H. Barrs and Benjamin L. Barrs, her heirs at law and distributees.
Your Orator and Oratrix further show unto your Honor that on the twelth day of February AD One thousand eighteen hundred and fifty the father of the intestate Claiborne Johnson Jeffcoat by deed bearing that date whereof a copy is here within filed as Exhibit A, to which reference is respectfully conveyed to the said Caliborne J. Jeffcoat the lands in the said deed described “to him and his heirs forever, that is to say after my decease and the decease of my wife, and I do so bind myself, my heirs, lawfully claiming the same or any part thereof, except the saw mill timber which all my male children is to have equal right to.
Your Orators further show unto your Honor that they donor, Benjamin Jeffcoat, departed this life on the ___day of May AD, One thousand eight hundred and fifty, but that his widow the said Mary Jefcoat is still alive and that the said Mary and the defendants Benjamin Jeffcoat and Wesley Jeffcoat began in the fall of eighteen hundred and fifty two, and Uriah began in eighteen hundred fifty three and Daniel J. Jeffcoat began in the Spring of eighteen hundred and fifty four, to cut down the timber and trees and small growth upon the said lands and to clean fields upon parts thereof for cultivation and continue to do so. That the lands cleared by them constitute some of the best lands upon the Murphy tract mentioned in the said deed; that the lands are all of a thin quality, and will be exhausted by use before the right of your Orator to enjoy the same____________. That all though no life estate is conferred upon Mary Jeffcoat by the deed, yet that until her death the right of your Orator to possession under the deed does not arise. That about twenty acres in all of the said land have been cleared by the defendants above named, and that they have a part of same in cultivation.
Your Orators further show unto your Honor that much of the defendants all are male children of Benjamin Jeffcoat, the donor, assert a claim under the deed where of Exhibit A is a copy to cut off and appropriate to their own use all of the saw mill timber upon the said lands, a claim which your Orators do by no means admit. But the said defendants have not confined themselves to the saw mill timber but have cut down the whole growth upon the land cleared.
And they further show that by far the largest portion of the lands is valuable mainly on account of the pine timber which in the lapse of ages has grown to a great size, tha if this be cut off by the defendants, they will have stripped the land of that which maily gives it value; that according to the universal rule it will not grow up in pine again, and that the growth, which will probably be black Jack, will require a longer periods than the lives of most of your orators to be rendered available to them for any useful purpose.
Your Orators further show unto you Honor that they _______some of them remonstrated against these acts of said defendants while they were in the act of cutting and clearing, and that this was done as early as before Christmas of the year eighteen hundred and fifty three. But your Orators understand that the said defendants claim the right to clear the said lands and to cultivate the same when cleared, and that to the exclusion of your Orator, and that they have a right to cut and use the saw mill timer; and indeed all the timber from the land, and the undergrowth and to clear the land.
Your Orator further show unto your Honor that some if not all the defendants who have -------this clearing these lands own other lands of as good quality more convenient to them and as to which their title is undisputed, yet they choose to pass by these, and exhaust the land to which your Orator will have a right upon the death of the said Mary Jeffcoat.
In tender consideration whereof and because your Orators are _____________in the premesis _____ in Court where matters of this sort are ______________ __________________. To the end therefore that Mary Jeffcoat, Benjamin Jeffcoat, Uriah Jeffcoat, Wesley jeffcoat and Daniel Jeffcoat may full _________ and perfect _____________make to all and singular the premises; that they may be restrained by injuction, from this honorable Court , from cutting down the timber upon the said land as well the saw mill timber or any other timber and from cutting and destroying the undergrowth and small trees and from clearing the land for cultivation, and from cultivating and wearing out the land so cleared by them, and from committing waste upon the land in the said deed mentioned and that your Orators may have such further and other relief in the premsis or to your Honor may ______ meet and the nature of their case may require.
May it please your Honor to grant unto your Orator a wit of subpoena to be added to the said Mary Jeffcoat, Benjamin Jeffcoat, Uriah Jeffcoat, Wesley Jeffcoat and Daniel J. Jeffcoat requiring them to be and appear in this Honorable Court to ___________ this _______________ and further to _____________ and abide by said order and decree therein as to your Honor may ______ meet, and that a writ of injunction do _______against the or above processed for that a writ of subpoena may _______ addressed to Thomas Williamson and Nancy Carolina Williamson his wife, and Elijah H Jeffcoat requiring them to appear as parties to this Bill, but not to answer the same unless they see fit, process being proposed against them only that all persons interested may be parties, and before the Court.
